Purpose: Secure The Overweb Trademark
A member of the Bridgit DAO Council will self-file a § 1(b) Intent-to-Use (ITU) application in Classes 9 & 42 to lock in our priority date and address a potential new applicant filing for “THE OVERWEB,” which could block our future registration.
Daveed Benjamin filed for a trademark “THE OVERWEB” with the U.S. PTO on January 28, 2021 under US Serial Number: 90495426 with the owner name The Overweb Foundation.
On March 10, 2022, the filing was abandoned because the applicant failed to respond or filed a late response to an Office action. To view all documents in this file, click on the Trademark Document Retrieval link at the top of this page.
On May 9, 2025, Daveed was contacted via email by an attorney notifying:
“It has come to my attention that another applicant has submitted an application for a trademark that is either identical to or confusingly similar to the abandoned mark "THE OVERWEB." As the rightful owner of the rights to this name, I would like to inform you that this application potentially infringes on those rights and creates a conflict in the trademark registration process.
Given that the previous registration for "THE OVERWEB" has been abandoned, I intend to proceed with the registration of the mark and will take the necessary steps to protect these trademark rights. The submission of this conflicting application may create confusion in the marketplace and could hinder the registration process.
Please be advised that, unless this matter is addressed promptly, further action may be taken to protect the rights to this trademark, including filing an opposition with the USPTO.”
Phasa Ras, Melinda Woods, and Joshua Colbert of the Bridgit DAO Council agree to split the self-filing fee of $700 that covers the filing process. The Council understands that the U.S. PTO process to grant a mark may include Office Actions or other follow-up inquiries that may require paid services from attorneys or related professionals.
Funds for the filing fee will be sent to the Bridgit DAO Account. If the USPTO issues an Office Action (e.g. asks for tweaks to our description), we will discuss and decide our course of action, which may include hiring legal representation to handle the response.
